The first requirement
The first and foremost requirement is to apply for Canada student spouse visa is that you must be legally married. if you are an applicant from India and is looking forward to apply for Canada open work visa provide proof of your relationship with your spouse the supporting partner in Canada . A marriage certificate is a legal document of your country which shows that you both are legally married. You need to meet this eligibility requirement
The second eligibility requirement for Canada student dependent spouse visa
Other than having a marriage certificate there are other documents you need to provide as a part of your visa application which shows that you are relation which is genuine and you have entered into this relationship to maintain it on a long-term basis and on an exclusive basis. If the case officer has doubts that you have entered into this relationship just to get Canada open work permit VISA based on the Canada student visa holder status then there are high chances that the case officer may refuse the application. The refusal reason may be that the case officer is not satisfied that you would leave Canada at the end of your stay.
Supporting partner that is Canada student visa holder conditions
There are other requirements your spouse that is who is a Canada study visa holder is required to meet. if spouse does not meet this condition then you will not be eligible to apply for Canada open work permit VISA .These requirements are as below
- The first and foremost requirement is start your spouse must be enrolled in the institute having a DLI status that is designated learning Institute status
- The second condition is satisfied house must have a current enrolment letter. If the supporting partner who is on Canada student visa does not have current enrolment letter this may have negative impact on your application
- The third requirement is start the course your spouse is enrolled for study in Canada must be eligible for post graduation work permit rights. This is a recent change which has been brought in by IRCC in late 2021. If the course in which your spouse is enrolled does not have post study work visa rights after the completion of the course then you will not be able to apply for Canada open work permit .so it becomes very important that the applicants see that the course they wish to study in Canada has got post graduation work permit rights associated with that.
